To bring a RICO claim, you must allege a predicate offense, defined in RICO to include certain specific crimes, such as extortion. There must be violation of a criminal statute to have a civil RICO claim. Mail and wire fraud are the two major financial crimes under RICO handled in federal court. Typically, state court RICO cases involve theft, embezzlement, or obtaining funds under false pretenses.

RICO is a highly specialized area in which very few cases get to trial. Most are dismissed due to failure to properly plead the facts supporting each element required by the RICO statute. Many cases that survive an initial motion to dismiss are resolved in summary judgment proceedings.

RICO is a highly technical and a very difficult statute to correctly state all the necessary elements, and it often results in a difficult case to prove. Even though the burden of proof is lower in civil litigation, the complex technical aspects of the statute make litigation difficult.
